Running a Mietwagen business in Munich: minimum fare, KVR rules and your numbers

You don't have to apply Munich's Mietwagen minimum fare at the moment: on 6 October 2026 the Munich administrative court halted the city's order (€5.13 base fare plus €2.43 per km up to 7 km) in urgent proceedings, and the city has suspended enforcement. The return-to-base rule, the TSE proof and the KVR's licence requirements still apply.

Uber minimum fare Munich

Does the minimum fare still apply to Uber and Bolt rides in Munich?

Not for now. Since the court's urgent ruling, the city is no longer enforcing its order. Nothing has been decided for good, though.

  1. The KVR publishes its general order (Allgemeinverfügung) on minimum fares in the city gazette, No. 17/2026. Gazette (PDF, German)

  2. The minimum fare takes effect, with immediate enforcement ordered.

  3. The Munich administrative court (VG München) restores the suspensive effect of objections in five urgent cases, including M 23 S 26.5032, brought by one Mietwagen operator and two ride-hailing platforms. Decision on gesetze-bayern.de

  4. The city stops enforcing the order "with immediate effect" and considers an appeal (Beschwerde). City of Munich

In short: the court considers the order probably unlawful as a whole because it also covers trips outside the city. § 51a(1) PBefG only lets an authority set minimum fares for Mietwagen services operated in its own district. Even a trip from Freimann to Trudering may run largely along the A 99 ring road outside city limits. Other disputes, such as EU law, were left open. VG München, M 23 S 26.5077 · § 51a PBefG

Stay prepared

What should Munich Mietwagen operators do now?

Keep your trip data in a state where you can back up every trip. You need that for the return-to-base rule anyway, and it is what any new minimum-fare rule would build on.

Back up trips per car

The suspended order asked for plate, start, destination, kilometres and price for every trip. If that data is already sorted per vehicle, you won't be scrambling when an inspector asks.

Think in net revenue

What counts is what is left per car and per driver after Uber and Bolt take their commission. Only then can you tell whether a car pays its way, with or without a minimum fare.

Watch the official sources

The city is weighing an appeal to the Bavarian Higher Administrative Court. As of 27 October 2026 we found no official update. Check the city's notice regularly.

Mietwagen licence Munich

What is a Mietwagen licence, and what does the KVR ask for?

A Mietwagen licence (often called Konzession) is the PBefG permit you need before carrying any paying passenger. In Munich it is issued by the trade office of the Kreisverwaltungsreferat (KVR), for a maximum of five years (§ 16(4) PBefG).

Requirements

  • personal reliability
  • professional competence, for example through the IHK exam
  • financial capacity: at least €2,250 equity for the first vehicle and €1,250 for each additional one
  • a registered base (Betriebssitz) within the City of Munich
  • a passenger transport permit (P-Schein) for every driver

Documents for a first application

  • clearance certificates from social insurance, city treasury, tax office and the trade association, no older than 3 months
  • insolvency court certificate, staff list and vehicle list
  • lease or proof of ownership for the base, and proof of a parking space per vehicle

Example

A licence for 10 vehicles

Equity: €2,250 + 9 × €1,250€13,500
Fee: €120 + 9 × €60€660
Processing time (KVR)3 months

Fees stated as "generally" by the KVR, plus trade registration, certificate of good conduct and register extracts. If refused or withdrawn, up to 75% of the licence fee.

TSE requirement

Do I need a TSE for a Munich licence?

As a rule, yes. A TSE is the certified security module German tax law requires for tamper-proof records. Since 1 January 2026 the KVR checks on new licences, renewals, vehicle changes and business start-ups whether taximeters and odometers meet the tax rules. You prove the TSE with an installation record (hardware) or a contract (software).

A mere order confirmation was accepted only until 30 June 2026, and proof of the installed TSE had to follow by 30 September 2026. That transition period is over.

Rückkehrpflicht

Does the return-to-base rule still apply to Uber Mietwagen in Munich?

Yes, fully. The Rückkehrpflicht requires a Mietwagen to head back to its base after each job unless it already has the next order. Germany's Federal Court of Justice confirmed it on 3 June 2026 (I ZR 123/25): without a cross-border element it falls outside EU law, and the court saw no serious constitutional doubts. BGH press release (German)

With 10, 20 or 40 cars on Uber and Bolt, you can't see who is waiting at the main station or the airport after a drop-off. An inspection, however, will find out afterwards.

"After carrying out the order, the Mietwagen must return to the base without delay, unless it received a new order from its base or the operator's home before the trip, or during the trip."

FAQ

Questions from Mietwagen operators in Munich

Is there a minimum fare for Uber rides in Munich?

Not one that is being enforced right now. The City of Munich set a minimum fare for Mietwagen (private hire cars) from 4 July 2026, which also covered Mietwagen trips booked through Uber and Bolt. On 6 October 2026 the Munich administrative court found the order probably unlawful in several urgent proceedings; the city has stopped enforcing it and is considering an appeal. The situation can still change.

How high would the Munich Mietwagen minimum fare be?

Under the suspended order: a base fare of €5.13 plus €2.43 per kilometre up to and including 7 km and €2.25 per kilometre beyond 7 km, VAT included, based on the shortest possible route. Discounts from operators or platforms were not allowed to push the fare below that level. Orders received provably at least one hour before the trip were exempt.

What is a Mietwagen licence (Konzession)?

It is the permit under the German Passenger Transport Act (PBefG) that you need to carry passengers for payment or on a commercial basis in a Mietwagen. It is granted for a maximum of five years (§ 16(4) PBefG) and covers the vehicles entered on it. In Munich, the Kreisverwaltungsreferat (KVR, the city's licensing department) is responsible.

How do I apply for a Mietwagen licence in Munich?

With the KVR's trade office (Gewerbeamt), which also accepts online applications. You need personal reliability, professional competence (for example the IHK exam), financial capacity and a registered base in Munich, plus documents such as tax and social-security clearance certificates, vehicle and staff lists, a lease for the base and proof of a parking space for each vehicle.

How much equity do I need for a Mietwagen licence in Munich?

At least €2,250 for the first vehicle and €1,250 for each additional vehicle, so €13,500 for ten vehicles. The reference date of the proof may be no more than one year before the application.

How long does a Munich Mietwagen licence take and what does it cost?

The KVR states a processing time of three months. The licence fee is generally €120, plus generally €60 for each additional vehicle, on top of fees for trade registration, a certificate of good conduct and register extracts. If the application is refused or withdrawn, up to 75 percent of the licence fee can still be charged.

Do I need a TSE for a Mietwagen licence in Munich?

As a rule, yes. Since 1 January 2026 the KVR checks on new licences, renewals, vehicle changes and business start-ups whether taximeters and odometers (Wegstreckenzähler) meet tax rules. A valid TSE, the certified security module required by German tax law, must be proven by an installation or contract record. The transition period for order confirmations ended on 30 September 2026.

Does the return-to-base rule apply to Uber Mietwagen in Munich?

Yes. Under § 49(4) PBefG (the Rückkehrpflicht), a Mietwagen must return to its registered base straight after each trip unless it received a new order before or during the trip. Germany's Federal Court of Justice confirmed this on 3 June 2026 (I ZR 123/25). Order records must be kept for one year.
